Your agreement for using Level3ID™ and Chrome Guard™

Welcome to Level3ID™! These Terms govern your use of the Level3ID™ website, API, and Chrome Guard™ extension (collectively, the “Service”). By using any part of the Service, you agree to these Terms and our Privacy Policy.

1. Acceptance of Terms

By registering for or using the Service you acknowledge these Terms. We may update them periodically; continued use constitutes acceptance.

2. Description of Service

Level3ID™ provides AI-driven identity verification tools that detect liveness and human presence in real time without storing raw biometric data. The Chrome Guard™ extension adds page-level protection for sensitive websites and may securely hold minimal personal data (name, email, encrypted facial image) for verification and fraud-alert purposes.

3. User Accounts and Registration

  • Registration & Accuracy: Provide and maintain accurate account information.
  • Security: You’re responsible for safeguarding credentials and notifying Level3ID™ of unauthorized use.
  • Consent: Enabling Chrome Guard™ biometric features implies consent to encrypted data collection solely for verification and protection.

4. API Usage and Restrictions

  • API keys must remain confidential and tied to authorized domains.
  • Use only for lawful purposes; no reverse-engineering or abuse.
  • Excessive requests may trigger rate-limit or suspension.

5. Subscriptions and Payments

  • Free Tier: Basic use under limited conditions.
  • Premium Plans: Expanded functionality per the Pricing page.
  • Billing: Auto-renews monthly via Stripe until cancelled.
  • Cancellation: Effective end of current period; no partial refunds.
  • Price Changes: May occur with advance notice.

6. Chrome Guard™ Data Storage and Security

  • Stored data: encrypted facial image, name, and email.
  • Purpose: liveness detection, fraud prevention, service alerts.
  • Encryption: AES-256 at rest / TLS 1.3 in transit.
  • Retention: purged within 72 hours of account deletion.
  • No sale or third-party sharing of biometric data.

7. Intellectual Property

All Level3ID™ and Chrome Guard™ software, designs, and documentation remain proprietary. You receive a limited, non-transferable, revocable license to use them in accordance with these Terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS.” LEVEL3ID™ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

LEVEL3ID™ SHALL NOT BE LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. TOTAL LIABILITY WILL NOT EXCEED FEES PAID IN THE PRECEDING SIX MONTHS.

10. Indemnification

You agree to defend and indemnify Level3ID™ and its affiliates against claims arising from misuse, breach, or rights violations.

11. Termination

Access may be suspended or terminated for policy violations. Biometric data will be deleted within 72 hours of termination.

12. SMS and Email Notifications Consent

When you install or enable Chrome Guard™ or any associated Level3ID™ mobile or browser feature, you may opt in to receive transactional SMS or email notifications. These alerts are limited to security and service events — for example, when Chrome Guard™ is disabled, interrupted, or detects suspicious activity.

  • Message frequency is event-based and typically low.
  • Standard message and data rates may apply.
  • You can opt out by disabling notifications or uninstalling the extension/app.
  • Level3ID™ does not send marketing or promotional texts through this channel.
  • Carriers are not liable for delayed or undelivered messages.
  • By opting in you confirm ownership of the provided phone number or email and consent to automated, transactional communications under the U.S. Telephone Consumer Protection Act (TCPA).

13. Governing Law

These Terms are governed by the laws of Tennessee, USA, without regard to conflict-of-law principles.

14. Miscellaneous

  • These Terms plus the Privacy Policy form the entire agreement.
  • If any clause is invalid, the remainder remains enforceable.
  • No waiver of rights unless in writing.
